10+2 Rule Adds to HS Classification Duties
For U.S. importers, HS tariff classification numbers have been an integral part of the global trade process for many years. Both importers and exporters from every country that belongs to the World Trade Organization must comply with the HS tariff classification number system, which affects more than 98 percent of global trade. And now United States importers have another concern in addition to HS classification. It's called the 10+2 Rule.
The new 10+2 rule, also known as the Importer Security Filing program, is a result of the SAFE Port Act of 2006. In addition to the HS tariff classification number, importers must electronically transmit 10 data elements to Customs and Border Protections 24 hours before loading any container onto a ship bound for the United States. These data elements are the manufacturer name and address, seller name and address, buyer name and address, ship-to name and address, container stuffing location, consolidator name and address, importer of record number/foreign trade zone applicant ID number, consignee number, country of origin, and Harmonized Tariff Schedule number.
Just like in the HS classification system, there is more than just one set of data that is required in each shipment classification. The ten data elements listed above must be accompanies by two data files that the ocean carrier will transmit to Customs and Border Patrol. Hence the name 10+2 Rule. These two data items are the Vessel Stow Plan, which indicates the location of each container on the ocean vessel, and the container status messages, which covers information about the movement and status changes of a container as it travels through the supply chain.
Importers are solely responsible for filing the Importer Security Filing, but they may authorize a third party to do so for them. The third party must be authorized by a Power of Attorney to file it on their behalf. With HS tariff classification numbers, 10+2 Rule and all the other rigors of the job, U.S. importers have their work cut out for them.
